Diamond 9 Productions – Corporate & Commercial Video Production Terms & Conditions

These Terms & Conditions (“Terms”) form a legally binding agreement between Diamond 9 Productions, operated by Videographer Harry Bristow (“Videographer”, “we”, “our”, or “us”), and the client company or individual (“Client”, “you”, or “your”) for the provision of video production services.
By confirming a booking, providing a purchase order, or paying a deposit, you agree to these Terms.
1. Project Scope & Confirmation
1.1. The Videographer will provide video production services as outlined in the agreed proposal or quotation.
1.2. The Client must confirm the scope, budget, and delivery requirements in writing before production begins.
1.3. Any changes or additional work requested after confirmation may incur extra costs.
2. Copyright & Usage
2.1. The Videographer retains full copyright of all footage and raw files.
2.2. The Client is granted a non-exclusive licence to use the final video for business purposes (e.g. marketing, social media, website use).
2.3. The Client must not re-edit, resell, or distribute footage to third parties without prior written consent.
2.4. The Videographer reserves the right to use excerpts for promotional purposes unless otherwise agreed in writing.
3. Filming & Scheduling
3.1. Filming will commence at the agreed start time and location.
3.2. Delays caused by the Client, staff, or contributors may result in additional charges.
3.3. If additional crew or equipment are required, these costs will be approved by the Client before proceeding.
4. Editing, Revisions & Delivery
4.1. The editing process will follow the agreed project brief.
4.2. One round of revisions is included. Further amendments will be charged at £30/hour.
4.3. The Videographer retains ownership of all raw, unedited material.
4.4. The final video will be delivered within the agreed timeframe, typically 3–6 weeks after filming.
4.5. Delivery will be via a downloadable link or client-specified method.
5. Payment Terms
5.1. Payment terms are 28 days from the invoice date, unless otherwise stated.
5.2. A deposit may be required before production begins.
5.3. Travel, accommodation, and additional expenses are charged to the Client if not included in the original quotation.
5.4. Payments must be made via bank transfer.
6. Cancellations & Delays
6.1. Cancellations made within 48 hours of the scheduled shoot may incur up to 50% of the project cost.
6.2. The Videographer is not responsible for delays caused by the Client’s failure to provide access, scripts, approvals, or information.
6.3. Any project postponed by the Client will be rescheduled subject to availability.
7. Liability & Insurance
7.1. The Videographer holds full public liability insurance.
7.2. The Videographer is not liable for loss or damage arising from circumstances beyond reasonable control, including weather, equipment failure, or data corruption.
7.3. The Client must ensure all filming environments are safe, legal, and accessible.
8. Confidentiality
8.1. The Videographer will treat all business information, trade secrets, and data provided by the Client as confidential.
8.2. Both parties agree not to disclose any confidential information without prior consent.
9. Force Majeure
Neither party shall be liable for failure to perform obligations due to events beyond reasonable control (e.g. illness, accident, natural disaster, or equipment breakdown).
10. Acceptance of Terms
By confirming a booking or engaging Diamond 9 Productions, the Client agrees to these Terms & Conditions in full.
